Banking

Our firm prides itself on its ability to effectively represent clients in the banking and financial services industry. The financial services industry faces many new challenges and financial institutions must make secure credit extensions, while dealing with a web of regulations pertaining to a bank’s financial health, protecting consumers and depositors, all the while controlling the flow of deposits and its loan portfolio. Our attorneys are uniquely qualified and have vast expertise in this practice area, with one of our founding members, Ramon Rasco, dedicating much of his career to the industry. His involvement includes not only the legal aspects of the field, but the practical experience of actually founding and running two Florida chartered banks.

We have since our founding represented local and international financial institutions, and the firm’s experience includes: real estate secured lending, including construction lending and loans secured by income producing property, asset based lending, such as asset based revolving credit facilities and other corporate banking transactions, export-import bank loans, factoring arrangements, equipment finance, and trade finance. Our regulatory and banking law practice assists clients in the formation of de novo banking institutions, consumer credit regulatory compliance issues, asset acquisitions and deposit transfers, business combinations involving financial institutions, and compliance issues specific to international banks.

Our firm is also experienced in assisting bank clients in the collection of distressed assets through legal proceedings, such as foreclosure, or through the negotiation of settlements agreements or “work-outs” of distressed bank assets. Each attorney in our financial institutions practice group, commercial lending, banking and regulatory compliance, and secured creditor litigation, understands that in today’s business environment our firm’s financial institution clients require solutions that are both complex and effective, sophisticated and at the same time results-oriented.
