Mark T. Reeves has advised clients involved in project development not only in the United States, but also throughout Latin America and the Caribbean. He has represented clients in developing renewable energy facilities and infrastructure projects, as well as data centers, hotel/casino projects, industrial facilities, university projects, professional sports facilities, and mixed-use projects. 

In past years, Mark worked with a large international law firm, primarily preparing and negotiating complex engineering, procurement and construction contracts, operations and maintenance contracts, and supply contracts for renewable energy facilities in the United States and Latin America, as well as providing claims management advice for those projects.  Before that, Mark served as a partner in a major Florida law firm with offices in Florida, England, the Caribbean, and Latin America, where he headed the construction law practice group.  He has also served as general counsel to a local university.  In addition to being admitted to the Florida Bar, Mark is a licensed architect in the State of Florida and has taught project development and construction law to architecture students at the University of Miami School of Architecture.  Mark is also a canon lawyer, and has provided canon law advice to institutions affiliated with the Roman Catholic Church in relation to corporate structure and governance, financing, and acquisition and disposition of real and personal property.

Given the varied skills which he has developed, Mark is ideally suited to carry a project from its infancy, through development, to completion, with the skills to guide a client through the sometimes-inevitable processes of claims management and dispute resolution. Mark has also represented clients before municipal and county boards in Florida and has worked with governmental and administrative staff, in zoning, planning and environmental matters.

REPRESENTATIVE EXPERIENCE

  • Preparation and negotiation of leases, subleases, software-as-a-service agreements, supply agreements, master service agreements for co-location services and managed services, OEM reseller agreements, mobile data center purchase agreements, shared use agreements with public utilities, operating agreements and other general business documentation for the development and operation of data centers, for a global data center developer, owner and operator.
  • Preparation and negotiation of both site-specific and master engineering, procurement and construction contracts, supply contracts, pilot agreements and energy-as-a-service agreements, for solar energy microgrid projects, for a private start-up company.
  • Preparation of an engineering, procurement and construction agreement to reconstruct an 85-million-pound-capacity warehouse for the off-loading of raw sugar at a seaport in Maryland, for a major sugar refinery.   
  • Preparation of revisions to a construction contract for a $60MM data center to reflect the requirements of Florida law, for a global publicly-held technology company.
  • Preparation and negotiation of a lease for the acquisition of 10.2 acres of land and the development of a $32MM fixed base operation facility, consisting of a state-of-the-art terminal, offices, and related facilities, including taxi-way improvements, at Miami-Opa Locka Executive Airport, for an innovative aviation company. 
  • Preparation and negotiation of a design-build contract as a part of a $3.2B public-private partnership flood diversion project in North Dakota.
  • Preparation and negotiation of a supply and installation contract for the construction of an $87MM automatic people mover system at Miami International Airport’s Terminal E, including claims management services, for a global supplier of people mover systems.
  • Preparation and negotiation of engineering, procurement and construction contracts for transmission corridors, static synchronous compensator substations and other facilities, together with extensive claims management advice, for a $950MM project, developed by a major power company, bringing hydroelectric power from Canada through Maine to Massachusetts.
  • Preparation of amendments to engineering, procurement and construction contracts, build-own-transfer agreements, and a purchase and sale agreement, together with related advice, for the pre-completion sale of several solar-powered electric generation projects, including a 435 MW AC photovoltaic facility with a battery energy storage system and a 200 MW AC photovoltaic facility, including all related interconnection facilities, for a US-based power company.
  • Preparation and negotiation of engineering, procurement and construction contracts and operations and maintenance contracts for an independent power producer in the development of four interconnected hydro-electric power plants in Central America, with a combined installed capacity exceeding 300 MW, including extensive claims management services.
  • Preparation and negotiation of engineering, procurement and construction management contracts and operations and maintenance contracts for a 250 MW photovoltaic power plant and a 300 MW photovoltaic power plant, including interconnection facilities, located in Spain, for a US-based power company.
  • Preparation and negotiation of an engineering, procurement and construction contract for a 185 MW solar energy generation project, including a stand-alone battery energy storage system and related interconnection facilities.
  • Preparation of engineering, procurement and construction contracts for developers of several liquefied natural gas (LNG) facilities throughout the Americas.
  • Preparation and negotiation of a supply agreement for a $9.2MM nuclear power turbine replacement at a nuclear power plant in southern California. 
  • Preparation and negotiation of construction contracts for a new $14MM printing press facility and corporate offices, for a  Miami-based news media company.
  • Negotiation of public construction contracts, and preparation and negotiation of subcontracts, for a $248MM project consisting of the development of extensions to the elevated people mover system within the central business district of downtown Miami, for a construction company based in Italy.  This representation included a contentious public bid protest and claims management services.  
  • Preparation and negotiation of construction contracts for a publicly-financed $28MM MLB Spring training facility in Florida, for two MLB teams.
  • Advice to clients on zoning, planning and related matters for various projects, including the professional football stadium in Miami-Dade County, Florida, a major residential project on a former US Navy base in Key West, Florida, a residential development in Broward County, Florida and a hospital office building in Hialeah, Florida.
