We work with clients as they plan their marketing and advertising campaigns for the products and services they offer and help secure protection for these products and services.

When clients need to protect or defend their intellectual property rights, we have extensive experience serving as lead counsel in both jury and non-jury trials in federal or state courts both within and outside of Florida, as well as serving as appellate counsel.  In addition, we are experienced in handling the arbitration of intellectual property disputes, both domestic and international.  Our goal is to work as closely as possible with our clients so we can provide result-driven representation in a cost-effective manner, to solve problems and achieve our clients’ objectives.

Rasco Klock’s Intellectual Property Practice includes trademark registration and monitoring and the prosecution and defense of trademark infringement claims. We also represent clients regarding trade secrets, dilution of trademarks, counterfeiting, gray market goods, copyright infringement, patent infringement, unfair competition, false advertising, infringement of the rights of publicity, Internet domain name disputes, and non-competition agreements. Our lawyers are regularly engaged to represent plaintiffs and defendants in trademark, trade dress, and copyright enforcement actions. Our firm serves as litigation counsel in patent infringement matters and related litigation for numerous multi-national as well as smaller companies, including biomedical, pharmaceutical, computer, Internet and other media companies, manufacturing and agribusiness concerns, and companies in the resort and hospitality business.

Our firm appreciates that the best resolution to any disagreement is to prevent it, thus we work with our clients to make sure a company’s trademarks, copyrights and other intellectual property rights are properly registered and protected through distribution, licensing and other agreements they might enter. Our intellectual property lawyers review and analyze the registration of trademarks and copyrights and prepare licensing and distribution agreements involving trademark, copyrights, patents, trade secrets and transfer of technology. We also provide intellectual property audits to determine what intellectual property a client may have and provide recommendations on how best to safeguard these valuable assets.

Our firm is highly experienced in intellectual property litigation. We represent both plaintiffs and defendants in federal and state courts throughout the United States,  in all areas of intellectual property.

Today, a number of intellectual property disputes, and in particular international disputes, are being resolved through the alternative dispute resolution (ADR) mechanisms of mediation and arbitration, rather than by traditional court litigation. Our lawyers are experienced with both pre-suit and post-suit mediation. We are also experienced in representing clients in a variety of arbitration forums. In addition, we have extensive experience in resolving disputes prior to litigation or arbitration through vigorous informal pre-suit negotiations, by working with our clients to find sensible business resolutions to intellectual property disputes.

On behalf of our clients, Rasco Klock also oversees intellectual property registration and litigation matters in jurisdictions outside the United States, including in particular the countries of Latin America and the Caribbean, by working with a wide network of firms in those jurisdictions.
