Banking

Since its founding, Rasco Klock has successfully represented clients in the banking and financial services industries. The financial sector has confronted, coped with and survived a number of setbacks in recent years, and now faces fresh challenges in dealing with a web of regulations pertaining to a bank’s financial health, protection of consumers and depositors, control of the flow of deposits, the integrity of its loan portfolio, and the resolution of industry and customer disputes.  We have helped our clients navigate these often-uncharted regulatory seas.  Our attorneys are uniquely qualified and have vast expertise in this practice area, with one of our founding members and current Managing Partner, Ramon Rasco, dedicating much of his career to the industry. His involvement includes not only the legal aspects of the field, but the practical experience of founding and chairing the board of directors of two Florida banks.

We have represented community, national and international financial institutions. The firm’s experience includes real estate secured lending, including construction lending and loans secured by income producing property, asset based lending, such as asset based revolving credit facilities and other corporate banking transactions, export-import bank loans, factoring arrangements, equipment finance, and trade finance. Our regulatory and banking law practice assists clients in the formation of de novo banking institutions, consumer credit regulatory compliance issues, asset acquisitions and deposit transfers, business combinations involving financial institutions, and compliance issues specific to U.S. and international banks.

Our firm is also experienced in assisting bank clients in the collection of distressed assets through legal proceedings, such as foreclosure, or through the negotiation of settlements agreements or “work-outs” of distressed bank assets. Each attorney in our financial institutions practice group, commercial lending, banking and regulatory compliance, and secured creditor litigation understands that in today’s business environment our firm’s financial institution clients require solutions that are both complex and effective, sophisticated and results-oriented.

The federal government, state regulators, consumers and competitors have all targeted the financial sector and, through over regulation, have attempted to weaken its otherwise strong position in the U.S. economy. Rasco Klock is keenly aware of the effects of overarching issues such as the national debt, the federal budget, interest rates, tax structures, and draconian regulations on the health and stability of our financial sector clients, and we are prepared to protect our clients’ rights and interests.
