Investor Files Multi-Million Dollar Lawsuit Against Carlos Barba, President & Founder of CaribeVision
Other CaribeVision investors include Burillo Azcarraga Group, formerly owners of Mexico’s Televisa Network, and Spain’s Tele 5
Coral Gables, FL – Mr. Alfredo Fraile, a well-known Spanish citizen has filed a lawsuit in the 11th Judicial Circuit Court in Miami-Dade, FL, USA, against Mr. Carlos Barba, President and Founder of CaribeVision, and his wife Mrs. Teresa Barba. The lawsuit alleges fraud and breach of fiduciary duties seeking compensation in excess of $1,000.000. Mr. Fraile aims to receive compensation for investments made in CaribeVision, LLC.
Mr. Alfonso J. Pérez, Esq. a partner in the Coral Gables based Law Firm of Rasco, Reininger, Perez, Esquenazi & Vigil, P.L. (the firm) is the legal counsel representing Mr. Fraile, and other investors in the CaribeVision project.
“I am very concerned about the millions of dollars invested by my clients. They have never received evidence of an ownership interest in Barba TV Group, LLC. That entity never even had a bank account and I don’t know if income tax returns have been filed. The money was apparently funneled to other corporate entities. The entity that actually owns the licenses issued by the FCC, has the majority of its shares in options owned by unknown third parties. We have demanded meetings of the Board of Directors to discuss this matter and to receive financial information and Barba and his lawyers have refused. Judge Hubbart has ordered that the Defendants, Carlos and Teresa Barba, file formal defenses within 20 days. I think the courts should appoint a receiver for all these companies,” states Mr. Alfonso J. Pérez, Esq.
In July of 2006, Mr. Fraile was invited by Mr. Barba to participate with CaribeVision, a Spanish television network in the United States, which launched in 2007 with stations in Miami, New York and Puerto Rico, as an investor and part of the management, which he did until April of 2008, when communication with Mr. Fraile was severed and he was denied access to the CaribeVision facilities. This allegedly occurred after Mr. Fraile questioned Mr. Barba regarding numerous management irregularities in the company. Mr. Fraile personally committed more than $1,000,000 and was able to raise more than $30,000,000 through his extensive industry contacts.
Mr. Alfredo Fraile has broad experience in the management and control of television stations and has worked as a personal consultant to Silvio Berlusconi, the Prime Minister of Italy, and was the Vice President of Tele 5 in Spain, until relocating to Miami to participate in the CaribeVision venture. Mr. Fraile alleges that he was promised a luxury apartment, a company car and sufficient funds for expenses, which did not occur.
The lawsuit states that Mr. Carlos Barba made representations that he owned the TV Stations. BTVG does not actually own the Stations and appear to be owned by an elaborate labyrinth of corporate entities. Mr. Fraile was additionally excluded from the operations of the companies that actually held the interests in the Stations.
